Adult Webmaster Video News
July 2nd, 2007 under Industry News. [ Comments: none ]

You knew someday someone would come up with a daily news and make it like you was watching a tv show. SleazyBear from Netpond has done such a thing, He calls it Adult Webmaster Video News, or awvns for short. Its a six day a week news program mainly about news adult webmasters would be interested in. Sponsor updates and changes, tidbits about webmaster boards, sometimes there is even a joke and always a webmaster tip at the end of the show. The nice thing about it, is its daily and you can listen to it or watch it. Sleazy says its been a long hard road to produce it, Starting out with a 15 inch screen on the desk to run advertisements to going full boat and getting a program that madhatter suggested to insert video into video. The interesting thing he told us was that most of the money the site makes will go into advertising the site on webmaster boards and other area’s which makes it a win win for sponsors to get more exposure to webmasters.. If you have shout outs or promos you would like him to announce or something you would like to see him talk about, contact him. The sites url is http://www.awvns.com

Calif. Legislators to Hear Adult Industry Tax Bill By Q Boyer
July 2nd, 2007 under Industry News. [ Comments: none ]

CANOGA PARK, Calif. — The FSC today announced that Assembly Bill 1551, a bill that would impose a tax on all California-based adult companies to ameliorate supposed “secondary effects,” will be heard Monday, July 9, by the Assembly Revenue and Taxation Committee.

The FSC, formally known as the Free Speech Coalition, asserted that the claims of the legislation’s supporters concerning negative secondary effects caused by adult businesses are baseless.

“Our Legislative Records Act request revealed that the author had no evidence whatsoever to support the claims of adverse secondary effects in his legislation,” FSC state lobbyist Matt Gray said.

The amount of the proposed tax is undetermined at this time, but the FSC said that the tax would “occur multiple times on the same product, both while in inventory and at the time of sale,” and that every time the same item changes hands, the tax would again be collected.

“We’d like to kill this bill in committee,” Duke said. “This is [state assemblyman and bill author Charles] Calderon’s committee, so we’d really like to defeat it there.”

This is not the first time Calderon, D-Whittier, has proposed taxing the adult industry; according to Duke, Calderon’s previous attempt to pass such a tax “went down in flames.”

“He didn’t get a single vote,” Duke said of Calderon’s 1999 bid to tax California’s adult businesses, an effort Calderon undertook when he was a state senator. “We have no idea why he would want to try this again.”

While the bill would only result in the direct taxation of adult companies in California, Duke said that the effects of the tax would be felt across the industry, and would set a bad precedent for other states to follow.

“If it happens in California, it will pave the way for it happening elsewhere,” Duke said. “This is dangerous for the country.”

Currently, the hearing is scheduled to take place at the State Capitol building in Sacramento, before the Assembly Revenue and Taxation Committee at 1:30 p.m. in Room 126. The FSC urged that people double-check the schedule as it is subject to change.

Duke called on members of the adult industry to show support for the FSC’s lobbying efforts. Duke said that letters to Assembly members, Fiona Ma, D-San Francisco, and Mike Feuer, D-West Hollywood, in particular, would be most helpful.

“We feel certain we can defeat this,” Duke said, “And a show of support from the industry would help a lot.”

For more information on the legislation and the FSC’s lobbying efforts against it, call the FSC at (818) 348-9373.

MoviesByMail.com Owners Charged With 6 Obscenity Counts
July 2nd, 2007 under Industry News. [ Comments: none ]

Two owners of online adult retailer MoviesByMail.com accused early this month of violating obscenity law have been formally charged with six counts of distributing obscene materials, three via the Internet and three via the U.S. Postal Service.

If convicted, Sami R. Harb and Michael Harb of Cleveland could face up to five years in prison for each count. The two are expected in court July 12.

The investigation into the duo’s online enterprise began in August when the FBI’s Adult Obscenity Task Force received a tip that the website was selling alleged obscene DVDs. In March, FBI agents placed an order for “Max Hardcore: Pure Max 18,” Max Hardcore: Extreme 12″ and Extreme Associates’ “Cocktails 5″ and had them shipped to Utah.

Just days before the two were arrested, Hardcore himself was indicted on 10 counts of federal obscenity. He is to appear in California court July 12.

Sami Harb told XBIZ that it was hardly a coincidence that the titles used against him happen to be from a company already under indictment.

“That was convenient, wasn’t it?” Harb said. “No one gets that lucky. It’s [the government] flexing its muscles, showing the conservatives and Republicans that they’re doing something.”

According to U.S. Attorney Brett Tolman, these movies have no artistic value.

“The U.S. Department of Justice and U.S. Attorneys’ Offices nationwide have stepped up the prosecution of obscenity cases, as evidence increases of the harm of obscenity to American children and families,” Tolman said. “As obscene materials continue to proliferate, they are becoming more accessible for the young and the innocent among us. At the same time they are becoming more extreme and degrading in content and present a growing threat to the wellbeing of American families and our society as a whole.”

According to court documents, MoviesByMail.com distributed 683 packages to Utah addresses in 2006.

“That tells me somebody there wanted them,” Harb said.

Harb also said he doesn’t expect to go to prison.

“I don’t think it’ll get to that point,” he said. “I don’t think that’s [the government’s] intention — it’s always been their intention to put people like us out of business. I guess the people who want to buy [adult movies] don’t count.”

Death Squads Reportedly Targeting Iraqi Adult Web Surfers
July 2nd, 2007 under Interesting Articles. [ Comments: none ]

Dozens of Iraqi citizens have been murdered after using the Internet to access adult websites, according to Middle Eastern media reports.

“We have received information from many sources that militants are operating spies inside Internet cafes just to find out who is browsing sites they have deemed offensive to Islam,” Iraqi Aid Association spokesperson Fatah Ahmed said. The IAA is a Baghdad-based nongovernmental aid agency.

According to Ahmed, most of the killings and abductions have happened directly after the victim leaves an Internet café.

“It is very serious because in an Islamic country in which violence is spreading on a daily basis, people search for some entertainment and it is found today only on the internet,” Ahmed said. “There are no places to go, so young people are making friends via chatrooms, which are now also being condemned by Islamic extremists.”

One victim of kidnapping and assault, university student Ibraheem Abdel-Qahar, told Al-Jazeera that he was kidnapped after leaving a café, then blindfolded, transported to what he believes was a house on the outskirts of Baghdad, and then beaten and tortured.

“They told me to take off all my clothes and handcuffed me. They started to beat me and use cigarettes to burn my legs,” Abdel-Qahar said, adding that he was beaten with an iron bar, and forced to drink chicken blood and his own urine.

Abdel-Qahar said that he was desperate, shouting questions at his abusers as to why they were assaulting him.

“After three hours of continuous torture they told me that it was because I was watching non-Muslim sites on the internet,” Abdel-Qahar said.

Following six days of torture, Abdel-Qahar said he was dropped off near his home and told that if he was found surfing adult sites again he would be killed. The perpetrators also advised him to seek salvation in the local mosque.

Legal Bear in the Woods , By Lisa Dowling

There are hundreds of stories of how mainstream professionals find their way into the adult business. Most will admit it’s by accident. Renowned litigation attorney Paul Berra is no different. His path into the adult industry certainly was accidental.

As one of the outstanding litigants at the high-profile entertainment law firm of Los Angeles-based Lavely & Singer, Berra successfully represented a number of celebrity clients who found themselves in the embarrassing position of having unauthorized, explicit videos splashed across the Internet.

He repped Rick Salomon when he battled against Paris Hilton and their much-publicized sex tape, helping Salomon acquire property rights when the tape made its Internet debut. Berra has also been involved in a sex tape lawsuit for Colin Farrell and unauthorized videos involving Cameron Diaz and Carolyn Murphy.

Berra currently represents XPays, the company that acquired Internet enforcement rights of the Hilton tape. In 2004, XPays officially obtained selling and marketing rights to the video and subsequently filed copyright infringement lawsuits against several sponsor programs. At present, the Hilton videotape case is still deep in factual investigation. Each of the defendants has been served and Berra is scheduling depositions.

“Because of the proliferation of these videos on the Internet and various adult sites, it forced me to understand Internet law, copyright infringement law, DMCA law and other adult industry issues,” Berra said.

Berra has taken that desire for understanding to remarkable heights. He has recently left Lavely & Singer and opened his own firm in Santa Monica, Calif., that specializes in intellectual property litigation, first amendment litigation, copyright litigation and understanding of the Digital Millennium Copyright Act (DMCA).

2257 Specialty
“I also specialize in 2257 issues, the section of the federal law that concerns proper record keeping for adult content,” Berra said. “This area of the U.S. Code is essentially a record-keeping requirement to ensure that people who appear in adult movies are over a certain age. It’s a big issue.”

How did this Detroit-born boy become such a shining legal star? It all began for Berra at the University of Wisconsin Law School. From the moment he graduated in 1996, Berra began successfully litigating cases, spending his first six years as an attorney at a large firm in downtown L.A. Finding general business litigation a bit boring, he moved on to Lavely & Singer and spent the next four years honing his litigation skills with top entertainment clients.

“For me, it’s all about fighting and figuring out ways to solve complicated problems,” Berra said. “Litigation is about finding the most efficient way to solve problems. It is incredibly challenging and I like a challenge. Entertainment litigation is very cutting edge, very high stakes and [is] definitely very challenging.”

Berra has first-chaired a number of jury and court trials, including a complex environmental case against one of the country’s most powerful land use firms, and obtained favorable judgments in each case. He’s argued legal motions of every type in federal and state court, deposed persons from corporate execs to high-powered celebs, and has settled cases both informally and through mediation. And now he’s on his own.

“I decided to leave Lavely & Singer for a number of reasons,” Berra said. “Just not having a boss was a big appeal. Not having to be at work at the same time is also nice but being on my own has allowed me to be flexible as to the types of business I work on. I’m developing business better now. I’m moving more into the adult industry. It’s been a lot of fun and a learning experience for sure.

“The adult business, especially with regard to the Internet, is becoming more and more mainstream. I find it a really good thing to be involved in, not only for business but also in terms of development of law [regarding] privacy rights and intellectual property rights.”

At present, 50 percent of Berra’s clients are adult industry- oriented with the other 50 percent involved in mainstream entertainment. How does he choose a client?

“I’ll take on anybody that I like and, of course, any client that I am confident we can maintain a healthy relationship together,” Berra said. “The kinds of cases I will accept are essentially any type that is not involved in a specialty area like divorce or criminal law.

“As a civil litigator, you can do any number of things, but if you don’t have the necessary experience, such as divorce law, you can’t do well by your client in certain situations.”

Berra does very well by his clients for general business litigation, entertainment litigation as well as intellectual property law and privacy rights issues. His core philosophy is all about the end product.

“First and foremost, I immediately look for reasonable, efficient solutions,” Berra said. “If that doesn’t work, it quickly becomes very aggressive, hard-hitting litigation. I am very mild mannered, but I’ve learned that in order to get results expeditiously, you have to be very up on the issues. You have to spend hours reading law and be very, very aggressive — otherwise you won’t last.”

If his stellar track record is any evidence, Berra is sure to last. His short-term goal is to make sure that his new firm grows and stays healthy. Long term, this competent counselor hopes to become one of the most recognized and respected attorneys in both the mainstream entertainment and adult industries.

“I would also like to be recognized as an expert on Internet law and the various cutting-edge issues that spring up every day,” Berra said. “I want people in the adult business to know me, trust me and have good things to say about me as a lawyer and a person. Someone they’d like to hang out with at events.”

The Crossover , By John Stuart

Less than two years ago, Pamela Butkowski was working in mainstream distribution, and wondering how she could get into something new that would take advantage of her marketing background. At the close of 2005, the Cleveland native saw her chance. DVDs For A Buck, an adult DVD program that had been online for two years, was for sale. Butkowski took the plunge.

“It was a music club mold that works off the same basic tenets as the Columbia House Record Club,” Butkowski said. “The big difference is we don’t do contracts, which is what everybody hated about the music clubs. They tied you into a minimum number of purchases, or a lifetime contract of having to buy something every month. We don’t work like that.”

How DVDs For A Buck works is simple. Customers pay a monthly membership fee of $34.95, and new members get a bonus offer, just like the record clubs, in which they receive five movies for a dollar. After choosing which five movies they want, new members receive them in the mail with no shipping charge.

“Then each month they get two movie credits,” Butkowski said, “so they can log into the system and choose whatever movies they want to order with those credits. So no money changes hands, other than the monthly fee. Most movies are one-credit movies, and customers can purchase movies, as well. They’re competitively retail-priced, and they get 40 percent off after the first movie they buy. We charge regular shipping on movie sales.”

Whatever Butkowski is doing seems to be working, because DVDs For A Buck is more profitable than it was under its previous owners. One of the changes she’s made is to bring in movies from a number of new studios that the original owners didn’t have. Customer longevity has increased over the previous ownership, too, according to Butkowski. She thinks her company’s model may be key to its success.

“We’re the only ones using the Columbia House model, where you pick the movies you want and you own them,” she said. “My direct competition is the retailers and video-on-demand, but there are lots of people who want something physical in their hands if they’re spending money.”

Butkowski believes her company appeals to a specific type of consumer, who will continue to buy DVDs as long as the site maintains its advantages.

“If they’re really into buying porn, it’s really a good deal for them,” she said. “For most customers, the $34.95 gives them two movies per month. These movies usually retail at $24.95, so they’re getting $50 worth of movies with no shipping charge.

“The other upside to the club is that it’s physical product. I think watching porn on the computer sucks. I have to screen a lot of movies on my laptop, and it makes me think, if you want to watch porn, do you really want to watch it on a computer? Besides, a lot of people out there still don’t have the ability to watch it on a computer. They’re still on dial-up and their computers don’t have the capability. My family is back in Cleveland, and their DSL service drops out all the time. They’ve only got a choice of two DSL providers, and they’re both terrible. I don’t know how people back there get any work done, let alone watch porn on their computers.”

Since taking over DVDs For A Buck, Butkowski has modernized the site to make it more customer-friendly, as well as more profitable.

“We have an algorithm built into our program that looks at the niche the customer likes, and looks at all the purchases that customer has made,” she said. “Then it compares that to what we have in our database, which that customer hasn’t yet ordered. That way we can customize our offers, and that makes it a little more dynamic.”

Although she feels that the adult retail stores remain her main source of competition for DVD sales, Butkowski is certain that her site holds one undeniable advantage over them: privacy.

There are still many consumers, especially women, who are not comfortable buying product in a store, where there is so much visibility.

“We have a lot of customers that order transsexual movies, and those people are generally men,” she said. “That’s not exactly something they’d feel comfortable buying in a store, so this is a way somebody can get what they want discreetly. We mail it to them in a plain brown box, which is also discreet.

“We don’t sell out our mailing list, and we also don’t pass customer information to other sites.”

What Do You Tell Your Family You Do? , By Chimera
July 1st, 2007 under Interesting Articles. [ Comments: none ]

So what have I to say this week? Not all that much webmastering (mistressing in my case) is hard work however as I mentioned last week it is always good to take time for your family. Even if it doesn’t expand your empire it does keep them from emailing, calling and banging down your door to see if you are still breathing. Following my own good advice I have a meal with my sister twice a week sometimes more.
Last Tuesday my sister asked the “Big Question”. You know the one I mean? It comes between “Please pass the peas” and “Do you want more tea”.
Yes, the “Exactly what is it you sell?” question. A question dreaded by those among us who have less than understanding families and communities.
Please understand, I am not a really good liar. As a matter of fact I am a terrible liar and my sister is a very intense church going person.
So my answer had to be something other than “Well sis, I look at naked people all day and write about them”.
The first thing out of my mouth was “Oh a lot of stuff but mostly fishing equipment”.
Bad choice I know zip about fishing but it was all that came to mind.
Silence reigned at the table for a little while and then she says “Well I am glad you have found something you love but,why fishing equipment and what kind?”
Errm yes… My mind was blank right around then and I blurted out. “Well, I sell poles big fishing poles and I write about stuff ..you know stuff like how they fit in your hand if they have a good reach. Though sometimes I sell drills and screwdrivers… You know stuff..”
“Oh she says what kind of fishing stuff, like zebco or one of them?” I can tell she is looking for something that is familiar to her.
“No says I, actually mostly the Ron Jeremy brand of pole”…She dropped the subject but I dread the day when she asks who Ron Jeremy is from someone who knows.
That is just a small and lame example of the kind of “half truths and untruths” we who sell porn must tell our family or in my case face an exorcist.
However there also exists a second kind of adult webmaster one who also sells porn with the full cooperation and sometimes collaboration of their significant other. I have a couple of friends on netpond in just such a situation. They market both adult and mainstream programs and both work full time in the industry. Now then the situation gets pretty amusing.
For instance, the girlfriend tells me the other morning they were working on some new sites. In order to write effectively we all know you end up viewing a number of videos and pictures from any sponsor you are promoting. She hears her boyfriend muttering nearby at his computer. Listening closely she realizes he is talking to himself. “Man spackle, baby batter, choad, love nectar…” She realizes he must be working on a cumshot and turns back to her computer.
Dinner table conversation in their home consists of:
“Dear, conversions are down on twinks this month, do you think we should push more traffic to big dicks?”.
“Honey would you look at my horny sluts site and let me know if I need more pussies?”
“Sweetheart you should let me make the big tit sites from now on or we are going to have to replace your keyboard. You keep drooling on it.”
Errm they are pretty funny couple to talk to.
I think my point, if I had a point here today is, if you must lie don’t tell them you sell a porn star’s pole.
Don’t let your boyfriend do the big tit sites even if he writes killer text!
Thank you Lucky and Biz for letting me share some of your personal life and I promise not to tell anyone about the time Lucky and you did all that research on….

Peace
