Girls Gone Wild Owner Faces More Legal Troubles |

PANAMA CITY, Fla. — “Girls Gone Wild” founder Joe Francis will be sent to Nevada to face tax evasion charges after he finishes his 35-day sentence in a Florida jail for contempt of court.
On Thursday, Federal Magistrate Judge Larry Bodiford ruled that Francis’ tax evasion charges in Reno, Nev., took precedence over the charges of sexual battery he’s facing in Florida. Court dates for the two hearings clashed on May 22.
Florida authorities wanted to keep Francis in custody until a trial for the sexual battery charges could begin, but he will go to Nevada to face charges filed in April accusing him of deducting more than $20 million in false business expenses on his companies’ 2002 and 2003 corporate income tax returns.
The indictment claims Francis used offshore bank accounts and entities purportedly owned by others to conceal income he earned during 2002 and 2003.
If convicted, Francis could be sentenced to as much as 10 years in prison and fines of up to $500,000.
Francis is also facing a misdemeanor charge for sexual battery after a January incident at a birthday party in Hollywood, Calif., where he is accused of touching an 18-year-old woman’s breast, buttocks and inner thigh at least 10 times, despite being asked repeatedly to stop.
Francis faces six months in jail and a $2,000 fine if found guilty of the sexual battery.
All About Him And What He Is About
Joseph R. (Joe) Francis (born April 1, 1973) is the founder of Mantra Films, Inc., which produces the Girls Gone Wild and Guys Gone Wild DVD series. Francis, who grew up in Laguna Beach, California, graduated from the University of Southern California in 1995 with a degree in Business Administration. He founded Mantra at the age of 24. He has appeared on Howard Stern’s radio show, and as a guest on The Man Show and other television programs. He has been in conflict with the law on frequent occasions with charges including rape and sexual assault.
Francis has been criticized by social commentators and third wave feminists such as Ariel Levy for perpetuating “the new double standard” which equates the objectification of women with sexual liberation.Francis built his empire upon the premise that he could capture, on video, college age women “going wild,” including baring their breasts for the cameras at spring breaks and other locales. As a result, Mantra recorded sales in excess of $100 million per year.
In the world of pop culture, Francis’ Girls Gone Wild was recently cited as an example of “sexualization,” number 23 on USA Today’s list of the “25 Trends that Changed America”.

XFANZ Erotica Film Fest ‘07 Announced |

Hollywood, Calif. — XFANZ , the online adult consumer portal, has announced the dates for its 2007 XFANZ Film Fest, a two-day consumer event that will showcase exemplary erotic video. The festival will take place Sept. 15-16, 2007, at the popular Knitting Factory in Hollywood, Calif.
The venue features three screening rooms as well as several lounges in which to dine and hang out. Screenings will run daily from 1–6 p.m. The opening night also will feature an XFANZ “Studio 69” party.
XFANZ will solicit creative submissions not only from the adult industry, but also from enterprising film students across the country. The film festival will challenge professional and amateur filmmakers to expand the limits of erotic moviemaking while also educating and entertaining festival attendees.
The first day of the festival will feature an “Old School” theme celebrating 35 years of porn on the big screen, with emphasis on the classics such as “Deep Throat” and “Debbie Does Dallas.” Stars and filmmakers of yesteryear will be invited to share their experiences with the audiences.
The second day will be “Cutting Edge,” during which studios, independent filmmakers and amateur directors submit and screen short films that represent their visions of what is the cutting edge of erotic entertainment.
“The XFANZ Film Fest celebrates the adult industry’s colorful history and aims to encourage both amateur and professional adult filmmakers to submit shorts that push new boundaries,” XFANZ Managing Director Alan Hawkins said.
XFANZ event planner Joetta said she plans to transform the gritty Knitting Factory into a scene reminiscent of the Studio 54 days.
“The XFANZ ‘Studio 69’ Party will pay homage to the glamour and overindulgence of porn’s big-screen beginnings,” Joetta said. “Stars and fans will come together to get their disco groove on or chill in the rock ‘n’ roll lounge. We’ll have bands, DJs and gorgeous dancers to entertain all night long.”
“There is a whole new generation of creative directors working in erotica,” XBIZ Publisher Tom Hymes said. “XFANZ is providing a hip showcase for their work, and also for the work of up-and-coming filmmakers. Add in a great venue, a cool theme and another awesome XFANZ party, and voila, you have two days filled with erotically-charged creativity.”

Popular KSEX Radio is getting a make over and they are adding stand up comedy and more music to appeal to a broader range of surfers than presently. They are hoping that these changes will brinng them a huge new amount of traffic to their site.
Personnel changes, announced Thursday by Belinkie on a live broadcast, included the dismissal of on-air host, Program Director and KSEX co-owner Wayne C. Lewis (”Wankus”), the promotion of on-air host Lorraine Summers (”Lorrainiac”) to Program Director, and the hiring of Joe Brandi as vice president and director of marketing. There are no further plans to dismiss any talent.
KSEX has taken over Internet radio operation Heat Party Radio, previously owned by Brandi, and programming will go from the current six hours live, five days a week, to 24 hours of new programming, five days a week. The programming will no longer be exclusively sexually oriented: Heat Party performers include music disc jockeys and stand-up comedians who broadcast from studios around the country. Some shows will be pre-recorded.

In part one below , we began our look at protecting your intellectual property rights. In this conclusion, we’ll examine registration of copyrights, trademark enforcement and more:
6 Good Reasons
In the case of copyrights, this means registering the copyright in works subject to the plan with the Copyright Office. There are a number of good reasons to register the copyright in works you want to protect:
* Registration prior to infringement will entitle the copyright owner to seek statutory damages of up to $150,000 for willful infringement of a registered work.
* Registration entitles the copyright owner to seek and be awarded attorney’s fees from the infringer.
* Registration establishes public record of copyright claim to help to prove willfulness in infringement suits.
* Copyright registrations can be recorded with the U.S. Customs Service for protection against the importation of infringing copies.
* Registration within five years of initial publication will establish prima facie evidence of the validity of the copyright in the work and the facts stated in the registration certificate.
* Registration of the copyright with the Copyright Office is a prerequisite to filing an infringement lawsuit against an infringer in federal court. So the copyright owner would have to register the copyright anyway if enforcement requires the commencement of federal litigation.
The registration fee for registering the copyright in a work is only $45. Considering all the benefits listed above, registering the copyrights in works is clearly one of the most cost-effective steps in any copyright enforcement plan. Forms for registration with explanations are available at the Copyright Office website at www.copyright.gov.
While the procedure of registering the copyright in a work is relatively simple, it does require a certain amount of accuracy and precision in following the rules associated with the filing. Consequently, many producers prefer to have an attorney to guide them through their first few filings.
Optimizing enforcement of trademark rights in the U.S. similarly requires registration of the mark with the U.S. Patent and Trademark Office.
The third part of an intellectual property rights enforcement plan involves the proactive policing of rights. Essentially, this means finding infringements.
For adult content producers, because of the rampant piracy of their works online, this usually requires some level of monitoring parts of the web and certain peer-to-peer networks for infringements.
Some companies who proactively protect their content perform this job in-house. Others hire an outside entity, such as BayTSP (www.baytsp.com) to spider all or part of the web and associated networks for infringements.
Encoding digitally distributed content with digital watermarks and other digital rights management information can be a very effective way of assisting producers in the task of finding infringements.
Consequently, evaluating and implementing such a rights management regime can also be an important part of a content producer’s policing of its rights.
The fourth part of a company’s IP enforcement plan involves, a cost/benefit assessment of taking action against one or more specific infringers. This involves an assessment of the type of infringers involved. For example, is the infringer a large company, a small company or an individual?
Does the infringer have any financial resources to pay damages, etc.? It also requires a determination of whether there are any joint or contributory infringers who knowingly benefited from the infringement.
For example, in some circumstances, marketing partners, affiliate programs, merchant processors, and even web hosting companies might be jointly and severally liable for damages, including statutory damages.
The fifth part of a typical intellectual property rights enforcement plan involves the execution of a series of steps to resolve infringements. Usually this involves the issuance of cease and desist notices followed by further actions, up to and including the filing of a law suit, as warranted by the circumstances of case. The specific type and sequence of actions to be taken in response to the detection of an infringement will vary from producer to producer and the type of work(s) involved.
Fortunately, regardless of the specific infringement response plan developed for a content producer, most enforcement actions will not require the filing of a lawsuit or the expenditure of a large amount of legal fees. In fact, it is generally the case that the more proactive a company is in enforcing its rights, the less its works are infringed.
Once a company acquires a reputation for enforcing its rights opportunistic infringers generally prey on less risky targets. For example, Disney is well-known for its low-tolerance of infringement of their works. As a result Disney content and marks are much less infringed than those of comparable entertainment companies.
In the adult space, Playboy and Digital Playground similarly have reputations for proactive enforcement of their intellectual property.
Proactive Enforcement
As an intellectual property rights attorney representing a substantial number of adult content producers, I can tell you that the typical initial reaction to the idea of expending any funds to protect and enforce intellectual property is that it will cost too much money.
But after discussing the real potential costs and benefits of instituting an intellectual property rights enforcement plan, almost every producer I have spoken to has adopted some form of intellectual property rights protection program.
I am proud to say that many of my clients have been pleasantly surprised that the costs of implementing an appropriate Intellectual Property rights enforcement plan has been less than what they originally expected before they learned about their options.
Industry Action
Unfortunately, the part of the content glut attributable to the availability of pristine pirated copies of producers’ content will continue until there is a substantial change in attitude towards infringers by the industry as a whole.
Consequently, I believe that the adult entertainment industry would benefit substantially from an industry-wide intellectual property protection summit to commence discussions about how content providers and reputable users of the content can best address the piracy problem. I have proposed such a summit to the Free Speech Coalition. It is my fervent hope that it will become a reality soon.
Until then, the adult content piracy war must be fought producer-by- producer and infringer-by-infringer. The hour is late, for sure, but the war is not yet lost.
Nevertheless, dire consequences lie ahead for the industry unless there is a change in attitude regarding producers’ protection of their intellectual property rights. So, to all the adult content producers reading this who have not yet become more proactive protecting their rights, I leave you with this: Its your property. It’s the digital age.
The choice is clear. You can protect your intellectual property, or you can lose it. It’s up to you.

The amount of adult entertainment content available to consumers today is enormous and growing exponentially. In fact, there has never been so much explicit erotica so readily available as there is now. Yet industry profits have slowed despite the fact that total revenues continue to increase. Many industry observers attribute this unfortunate situation to an oversupply of content. While this almost certainly true, it is not the whole story. To understand how the industry got into this predicament requires an understanding of how there got to be a content glut in the first place.
While it may be surprising to some, the current oversupply of content is likely due, in large part to the industry’s decades-long failure to effectively enforce its intellectual property rights. This month’s article will explore how this failure is now propelling the industry into a true economic crisis that could undermine the profits of large segments of the adult entertainment business.
Adult entertainment producers create intellectual property. In fact, the primary products of the industry: videos, photographs, web sites, erotic stories, etc., are all works protected by the copyright laws of the U.S. and other countries. But despite the fact that adult entertainment companies are in the business of creating and distributing copyrightable works, from the beginning, with a few notable exceptions, adult content producers have generally shown little interest in enforcing their copyrights against infringers.
The reason given by some adult entrepreneurs for failing to protect their copyrights is that they do not want to expend the funds necessary to protect their rights. Others claim that, given the governmental hostility toward adult materials and those that distribute them, it is best for porn producers to steer clear of the legal system whenever possible.
Failure to Prosecute
Regardless of the reasons, however, owners of adult content have a long history of generally failing to prosecute parties that steal their content and infringe their trademarks.
Inevitably, the industry’s passivity has nurtured a culture of adult content theft. In fact, one might even say the industry has actually incentivized and institutionalized the piracy of adult materials in some circumstances.
For example, can anyone doubt that a typical affiliate marketing program operator is much more concerned with an affiliate’s ability to generate traffic than whether the affiliate has the rights to content used on the affiliate’s site? As a consequence, a lot of traffic is being created and directed by parties who steal the content and infringe the copyrights and trademark rights of others.
Unfortunately, rather than being penalized for such theft, the parties are rewarded with fat affiliate compensation checks.
Now, not surprisingly, after literally decades of the producers’ failure to effectively police their rights, parties that steal adult content can almost rest assured that their theft will, in most cases, never be prosecuted.
As a result, a substantial amount of adult content available the web and even on DVDs is pirated material. Some have estimated that infringements may account for as much as 50 percent of all adult materials available online world-wide. And the problem is getting worse.
Further compounding the piracy problem are a number of new sources of infringement that might soon make today’s level of theft seem small by comparison.
These include, for example, adult free video sites emulating the user posting features of YouTube, adult community web hosting sites emulating MySpace, but neglecting, if not encouraging, user postings of third party content to boost traffic and adult content peer to peer networks, including those requiring, as a condition of participation, the posting of adult materials without serious regard as to the contributor’s right to do so.
Energizing the use of these new mega-infringement machines, and further exacerbating the problem, is the entrenched, and growing, perception among the young that blatant and voluminous adult content sharing is a good thing.
Unfortunately, if left un-addressed, the piracy problem could soon become a profit sink capable of collapsing the profitability of large segments of the adult entertainment industry.
Like it or not, the business is being forced to confront the formidable challenges brought on, in large part, by its own inaction, in which rampant piracy was allowed to go unchecked.
What Can Be Done
Content owners are not defenseless in combating the onslaught of piracy they now face. Standing at the ready are powerful copyright laws that, when used effectively, can bring pirates and all those who knowingly benefit from their theft to task. Essentially, the copyright laws entitle a copyright owner to wield a “big stick” to enforce the copyright owner’s exclusive rights. For example, if you own a work protected by copyright that is being infringed, to enforce your rights, copyright law entitles you to invoke the power of the U.S. federal court system and the law enforcement apparatus of the U.S., including the U.S. Marshals, the Customs Service and, potentially, even the Justice Department. And if you are a content producer, having these bad boys on your side for a change can put some real power behind an intellectual property rights enforcement program.
For example, the copyright laws of the U.S. provide for the awarding of damages to copyright owners for infringement of their works amounting to the profits made by the infringers plus losses sustained by the copyright owner.
Moreover, if an adult video, photograph, website or other expressive work is properly and timely registered with the copyright office, the owner may be entitled to payment of statutory damages of up to $150,000 per work willfully infringed regardless of whether the infringer made any money unlawfully using the content or the owner sustained any losses from the infringement. Yes, that’s right, liability of up to $150,000 per work even if the infringer never made a dime from your content.
Also, should the industry pick up the gauntlet and begin to aggressively enforce its rights, it would soon discover that its interests are aligned with some of the most powerful and influential companies in the world.
This is because the problem of pirated content is not just an adult industry problem. The difficulty of preventing theft of digital content in the age of perfectly reproducible material that can be reproduced instantaneously and delivered anywhere in the world via the web is a problem that confronts the music industry, the motion picture industry, the computer games industry, the software industry and virtually ever other producer of digitizable content.
Some of these potential allies, most notably the music and film industries, are fighting back by suing many of the infringers of their content, even if the infringers are their customers.
While not a complete solution, this aggressive enforcement strategy has been credited, at least by the music industry, with stemming the tide and slowing the bleeding of music-industry profits.
So, what can be done by content producers and by the industry as a whole.
If you are a content producer and you are not currently enforcing your intellectual property rights you should start to do so as soon as possible.
Creation of an intellectual property rights enforcement plan is a good way to begin. This should be done with the assistance of a qualified intellectual property attorney. An experienced practitioner can help you determine how to best and most cost-effectively protect your rights and increase the value of your intellectual property assets.
Generally, most intellectual property rights enforcement plans can be divided into five parts:
First, the appropriate rights must be acquired and optimized for enforcement. In the case of copyright enforcement, usually, this entails that the content owner acquire via a “work for hire” agreement or other rights granting document all the rights in the content that are or might owned by persons who participated in the creation of the content.
This includes, depending on the type of work involved, rights granted by the models, actors, directors, video camera operators, photographers, editors, writers, music composers, music players, music producers, web site designers, and programmers, etc.
The second part of an intellectual property rights enforcement plan is the optimization of rights for enforcement.

No, there’s no doubt the earth is warming. However, so is Mars. Thinking that man is causing global warming is silly. Especially since the amount of CO2 produced by man is an infinitesimally small % of the CO2 produced by the oceans. The earth has warmed and cooled many many times. adapt to change, don’t cry about it.
2. Should the USA be in Iraq and if you would like to expand on it what do you
think the final out come will be?
Of course the US should be in Iraq. They were completely correct in going in and the two largest mistakes of the war were #1 not killing enough Iraqis and #2 allowing the media to tag along.
After 9/11, the US could not allow an enemy who possessed and used WMDs, harbored and financed terrorists, attempted to assassinate a former US president, and refused to live up to their surrender agreement to remain in power. It’s really very simple.
I believe the final outcome will be similar to the outcome among any group of savages. They’ll go on killing each other over their god whether we’re there or not. Because the US wants to always be seen as the good guys, we lost an opportunity to take all the oil we could from Iraq to help pay for the war and that’s a damn shame.

He’ll go down in history as a failure because the people writing history are flaming liberals who will overlook the fact that his economic actions after 9/11 single handedly saved our economy from ruin, his attacks on both Afghanistan and Iraq were both swift victories, unemployment is low, no other terror attacks have happened on our soil while attacks on other countries have continued, etc. etc. The liberal trash currently in charge of our history will not even footnote the tremendous opportunities he gave african americans in his administration.
4. In light of the recent College Shootings at Virginia Tech what do you
think about Gun Control Laws in the USA and what do you think should be done.
I think the laws on the books should be followed. The shooter at VT had a history of mental issues yet was not blocked by the system from getting a gun even though the law says he should have been.
Overall, however, the right of the people to bear arms is as much a founding principal of our country as the right of free speech. Our fore fathers went to great lengths to explain how without the 2nd amendment, you have no way of protecting the first.
Our country to this day has the minuteman militia mentality of picking up arms to protect family/community/country and that mentality of self determination is what separates us from the rest of the world. This attitude, I believe, is part of what has always allowed us to succeed on the world stage. Other countries look at us and see us bristling with guns for “no reason” and tsk tsk our love of them and laugh at our assertions that we could actually pick up arms and fight off an evil government or a foreign invader but at the end of the day, we imagine what is possible and the rest of the world is busy explaining what’s not possible.
In a nutshell, the second amendment is a glaring example of how Americans are different from the rest of the world.
5. What do you think of Radical Muslims and what do you think should
happen to them.
Radical muslims should be killed, period. Anyone who wants to live in peace, should be able to. Any threat to a peaceful society should be wiped off the face of the earth.
The real danger with radical islam is the civilized world’s fear of killing their enemies. Somewhere in the last 60 years, its gone out of fashion to kill your enemies. This makes your enemies happy but in the end, it will spell the end of modern civilization if we do not wake up.
There is no time throughout mankind’s history where an enemy like radical islam was pacified with a negotiated peace. We arrived at where we are today as a society by killing those who would kill us. Only an idiot would think that if you stop killing your enemy, your enemy will stop killing you.
6 Where do you think Osama bin Laden is? Will he ever be caught? How
do you think he will play out in history 25 , 50 , 100 years from now.
He’s in Pakistan. He will not be caught until radical muslims kill musharraf and we go to war with Pakistan. Then we’ll find him or kill him. Not before. He’ll go down as the biggest terrorist of the century. The ignition of radical muslim’s war against modern civilization.
7. What political figure changed the world the most and why?
hmmmm, tough to say just one but lets run with Hirohito. If he had not attacked pearl harbor and had prosecuted the war for another year, all of europe including england would have been lost to the nazis and germany and japan could have squeezed russia and then turned to the US.
Bringing us into the war early saved us from axis rule.

please expand on it.
They don’t realize how hard they have to work to get their business off the ground. For example, my detractors who like to explain how I was just lucky don’t realize that for about 6 months my day went as follows:
7:00am wake up and get to my day job.
5:00pm go home, get cleaned up, eat dinner and relax until 8:00pm
8:00pm go to the internet office and work online until 1:00am-2:00am
2:00am-7:00am sleep.
repeat daily for 6 months.
And this is when it was supposedly easy. Imagine how hard you have to work now to get to where I am.
Also, the other things new webmasters don’t get is that people who’ve been successful for 10yrs in this business really *DO* know more than they do.
The fact that you CAN post on a chat board doesn’t mean you SHOULD.
people with a lot of posts looking to trade chat board points for 5 dollars of epass should probably not be the people you take business advice from
If 10 people who really don’t know about the business all agree about something, it does not have as much validity as 1 person who *does* know the business and disagrees.
2. In your opinion what is the future of TGP’s and marketing with them?
I’m really not much of a TGP guy but I imagine that the regular webmaster will eventually be squeezed out of the business by program owners just buying the spots. Think about it, what’s the difference between paying a webmaster or paying a TGP directly? The TGP will be easier to deal with and obviously, the TGP owner would rather sell off every spot he can.

3. Do you think people are putting too much emphasis on Google and what
do you see as the future of Google. Do you see big changes in the future
or will search engines stay pretty much the same.
No, right now Google is getting the emphasis it deserves. Will that change? sure it will. There’s enough money out there to offer competition to google. (look at MS trying to buy Yahoo) There’s certainly enough money in MS to give google a run for it’s money. Search engines will continue to change but probably very slowly. google still does not have a handle on fraud which definitely holds them back from expanding their advertising base further.
4. Whats the main reason you think porn sales are down? How much do you
think all the free porn out there plays a part.
I don’t think sales are down at all, I think its simply a case of spreading sales among so many more people. While there is certainly too much free porn out there, sales are NOT down, they’re merely spread out among more people.
My opinion on free porn is that as bad as it is, there is no putting the genie back in the bottle so lets move on and do whatever else is best for your business.
5. Saw your thread about Google’s new policy towards Adult Domains. What do you
think was Google’s reasoning behind this. Do you think it was political
pressure from the USA or just Google’s Bottom line.
I think it was a multitude of negatives that piled up to make their decision easy. You’ve got various types of fraud including pointing high volume low value traffic towards high value ads, the stigma of adult in a mainstream marketplace, and a few other smaller issues that probably just made them say, “nah, this isn’t for us”
however, don’t be surprised if google pulls the rug out from under the rest of the domain parking market as well. The fraud factor looms large in mainstream as well as adult and google is propping up the entire market at its current levels. Mainstream markets are sagging and could be heading for another crash (my opinion on this is the main reason I came back to focus on adult) and with google helping to cut off its own popup nose to spite its advertising face, google has no strong way to assist its clickthru earnings.

Great tool? no. tool we might as well use while its here? yes. I mean, it is as much a part of the free porn problem as TGPs but they’re both here so you better figure out how to use them. I think there will be many legal battle about copyright infringment, etc. but at the end of the day, porn is not going to sue them, porn will use them so even if the video share people can’t show copyrighted stuff, porn people will line up to participate.
So, as far as this goes, learn to use it and evolve your methods as the format evolves.
8. Whats the one thing you feel webmasters considering promoting 12 Clicks Cash
should know. Whats your biggest selling point.

9. Where do you see the adult industry in 5 years from now and what do
you think is the biggest threat to it. Will the present affiliate system
of marketing survive or do you see more companies going to doing their own

while 5 years is a long time, I don’t expect much change. I mean, look at 5 years ago. See much difference? I don’t. However, I do see the continued squeezing of the webmaster. Back when I started, it was easy for a webmaster to earn a good living just from webmastering. Its now going to be more and more difficult and what you’ll end up with is a webmaster work force made up of all part time webmasters. I also see a strong move towards in-house marketing of all types; SEO, SEM, blogging, freesites, tgp submissions, etc. as catering towards webmasters becomes more and more expensive.
It’s really not a pretty picture for webmasters. Sorry guys.
